Terms and Conditions

These terms govern access to and use of the Finex app and website, owned by Brava AM Solutions SL, tax ID (NRT) NRT L-717603-E, registered at Carrer del Clos 1, casa 2A, AD300 Ordino, Andorra.

By registering for or using Finex you accept these terms in full. If you do not agree with any part of them, please do not use the service.

1. What Finex is (and what it is not)

Finex is an educational personal finance organisation tool. Based on the data you enter, it works out your financial health level, suggests an action plan made of general steps, and gives you calculators and educational content.

Finex does not provide personalised financial advice. Its content, plans and calculations are informational and educational and do not constitute a personal investment recommendation within the meaning of Directive 2014/65/EU (MiFID II) or the Spanish Securities Market Act, nor do they constitute tax, legal, accounting or insurance advice.

Finex is not registered as an investment firm, broker-dealer, financial adviser, payment institution or credit intermediary with the Spanish securities regulator (CNMV) or the Bank of Spain, and it provides none of the services reserved to such entities.

Calculator results are estimates. They are produced by applying standard financial formulas to the data you enter and to assumptions about returns, inflation or interest rates that may not hold. Past performance is no guarantee of future returns. Before making any significant decision, consult a duly authorised professional.

2. Your account and minimum age

• To register you must be over 18 and have legal capacity to enter into a contract. By creating an account you confirm that you meet both requirements.
• You must provide truthful information and keep it up to date. The quality of the recommendations depends directly on how accurate your figures are.
• You are responsible for safeguarding your credentials and for all activity carried out from your account. Tell us immediately if you detect unauthorised access.
• Your account is personal and non-transferable. You may not assign, sell or share it.

3. Acceptable use

When using Finex you agree not to:

• Use the service for unlawful or fraudulent purposes, or in bad faith.
• Impersonate anyone else or register accounts using false details.
• Extract content automatically (scraping), reverse engineer, decompile or attempt to access the source code or the database.
• Introduce malicious code, overload the infrastructure or interfere with the normal running of the service or with other users' security.
• Reproduce, resell or commercially exploit Finex content, calculations or materials without written permission.

We may suspend or close, without prior notice, any account that breaches these terms or puts the service or other users at risk.

4. Affiliate links and advertising

Finex is free for you. It is funded through affiliate agreements with the providers whose products are linked from the app.

• We may receive a commission from the linked provider if you sign up or take out a product through our links. That commission is paid by the provider, never costs you anything extra, and does not worsen the terms you would get on your own.
• Paid links are clearly labelled "Advertising" wherever they appear, in line with advertising and consumer protection rules.
• The fact that a product appears in Finex does not mean it is the best on the market for you, nor is it a personal recommendation. The selection we show is limited and is not an impartial analysis of every product available.
• Finex takes no part in the contracting process. If you decide to sign up, the contract is exclusively between you and the provider concerned, under its own terms, fees, requirements and privacy policy. The provider is solely responsible for the product, the onboarding process and customer support.

5. Third-party products and risk warning

• Investing: investing involves risk. Your capital is not guaranteed and you may lose part or all of what you invest. Past performance is no guarantee of future returns, and the app's projections are purely illustrative.
• Crypto-assets: these are highly volatile products, they can lose all of their value, and they are not covered by the Spanish deposit guarantee fund or by the investor compensation scheme (FOGAIN). Only invest in them if you fully understand the risks.
• Deposits and accounts: deposits held with credit institutions authorised in the EU are covered by the relevant deposit guarantee scheme, up to the legal limit of €100,000 per depositor per institution.
• Mortgages: the interest rate, the instalment and the total cost depend on the binding offer made by the lender. Finex simulations are neither an offer nor a financing commitment.

Always read the pre-contractual information, prospectus or key information document provided by the institution before taking out any product.

6. Mortgage review requests

Finex gives you the option of having a partner mortgage broker (Gibobs allbanks) review your case and get in touch. It works like this:

• You fill in a form with your details and those of the property. Until you submit it, the draft is stored in your account and you can delete it whenever you like.
• Sending your details to the broker is manual and requires your explicit consent, given by ticking the relevant box before the request is submitted.
• Finex is not a mortgage credit intermediary and does not provide the intermediation services regulated by Spanish Law 5/2019 of 15 March on real estate credit agreements. We do not negotiate terms, we do not assess your creditworthiness, and we neither grant nor broker loans.
• Any intermediation service is provided by the broker under its own responsibility, with its own terms, fees and privacy policy. Any contractual relationship that arises is between the broker (or the lender) and you.

7. Intellectual property

The Finex trade mark, the design of the app, its code, texts, calculators, graphics and all other content belong to Brava AM Solutions SL or to third parties who have authorised their use, and are protected by intellectual and industrial property law.

We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use the app for your own private purposes. Any reproduction, distribution, public communication, adaptation or commercial exploitation of the content without our prior written permission is prohibited.

8. Service availability

The service is provided "as is" and "as available". We take reasonable steps to keep it running, but we do not guarantee uninterrupted availability or that it will be free of errors. We may modify, suspend or withdraw features, and interrupt the service for maintenance or for reasons beyond our control.

9. Limitation of liability

Finex is not liable for:

• The financial decisions you make on the basis of the app's information, plans or calculations, which are indicative and educational.
• Incorrect results caused by inaccurate, outdated or incomplete data entered by you.
• Losses, fees or damages arising from products taken out with third parties through our links, for which the provider is entirely responsible.
• The content, availability or practices of third-party websites we link to.
• Interruptions, technical failures or data loss beyond our reasonable control.

Nothing in these terms excludes or limits our liability for wilful misconduct, gross negligence or personal injury, nor any other liability that cannot be excluded under Spanish law, in particular the rights granted to you by consumer protection legislation.

10. Closing and deleting your account

You can stop using Finex and delete your account at any time, free of charge, under Settings > Delete account. Deletion erases your data within the periods set out in the Privacy Policy. For our part, we may close your account in the event of a serious breach of these terms or if the service is discontinued, giving you reasonable notice wherever possible.

11. Changes to these terms

We may amend these terms to reflect legal, technical or service changes. The version in force will be published on this page with its update date and, if a change is significant, we will tell you inside the app or by email. Continuing to use the service after a change takes effect means you accept it; if you do not agree, you can close your account.

12. Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, any dispute will be submitted to the courts of the place where you are domiciled, and nothing in these terms limits the rights granted to you by consumer protection legislation. In all other cases, the parties submit to the courts of the owner's registered address.
